General Terms and Conditions of Sale
Maison Sveltesse
1. Introduction
These general terms and conditions of sale (hereinafter the "GTC") set out the contractual rules governing transactions between Maison Sveltesse (hereinafter "the Seller") and any natural or legal person (hereinafter "the Customer") wishing to purchase products offered by Maison Sveltesse.
These GTC apply to any order placed via the Maison Sveltesse website (www.maisonsveltesse.com) or in person in the cities of Brussels, Rotterdam and The Hague. They define the rights and obligations of the parties regarding the sale, delivery, payment and use of the services offered by Maison Sveltesse.
By confirming an order on the Maison Sveltesse website or by making an in-person purchase, the Customer acknowledges having read and accepted without reservation these GTC, as well as the specific conditions applicable to each transaction.
2. Purpose
The purpose of these general terms and conditions of sale (hereinafter the "GTC") is to define the contractual terms governing sales concluded between Maison Sveltesse (hereinafter "the Seller") and any natural or legal person (hereinafter "the Customer") wishing to purchase products via the Maison Sveltesse website or in person in Brussels, Rotterdam and The Hague.
The GTC determine the steps required to place an order, the processing of orders, the payment terms, as well as the delivery conditions of the products ordered. They also govern the exercise of the right of withdrawal by the Customer, the warranties applicable to the products sold, and the respective responsibilities of the Seller and the Customer throughout the sales and delivery process.
By accepting these GTC when confirming their order, the Customer acknowledges having read the specific conditions relating to each transaction, as well as the rights and obligations arising therefrom in accordance with Article L111-1 of the Consumer Code.
3. Orders
Orders for the products offered by Maison Sveltesse can be placed in two ways:
Online orders: The Customer may place an order exclusively via the Maison Sveltesse website (www.maisonsveltesse.com). By placing an order on the site, the Customer fully acknowledges and accepts these general terms and conditions of sale (GTC), as well as the specific conditions applicable to each transaction.
In-person orders: For Customers located in Brussels, Rotterdam and The Hague, it is also possible to place an order in person directly with Maison Sveltesse. In this case, confirmation of the order on site also implies full acceptance of the GTC.
Acceptance of these GTC is a prerequisite for validating any order. By confirming their order, whether online or in person, the Customer certifies that they have read, understood and accepted all the contractual terms governing the transaction, in accordance with Article 6:227b of the European Civil Code and Article L221-14 of the Consumer Code.
4. Prices
The prices of the products offered by Maison Sveltesse are stated in euros and include all applicable taxes, including VAT (all taxes included). Maison Sveltesse reserves the right to change its prices at any time due to economic variations and production costs. The prices displayed on the website may therefore be changed without notice.
However, once the Customer has confirmed their order, the price to be paid remains fixed and will not be subject to change, except in the event of an obvious error. By confirming their order, the Customer acknowledges and accepts the price of the products as indicated at the time of confirmation. This acceptance is an essential condition for the formation of the sales contract between the Seller and the Customer.
This pricing policy complies with Article 6:230 of the European Civil Code and Article L112-1 of the Consumer Code, which govern the terms for setting and changing prices in the context of sales of goods by professionals to consumers.
5. Payment
Payment for the products offered by Maison Sveltesse is due immediately at the time of ordering, including for pre-order products. The Customer must pay the full amount of their order, including the price of the products, any delivery costs and all applicable taxes, in order for their order to be processed and validated.
Several secure payment methods are made available to the Customer: they may pay for their order by bank card, PayPal, or any other accepted payment method specified on the Maison Sveltesse website. For purchases made in person in Brussels, Rotterdam and The Hague, cash payments are also accepted.
All online payment transactions are secured by encryption and security protocols compliant with current standards, guaranteeing the protection of the Customer's personal data.
By making a payment, the Customer confirms their consent to these general terms and conditions of sale and definitively validates their order, in accordance with the provisions of Article 6:231 of the European Civil Code and Article L221-13 of the Consumer Code.
6. Delivery
The products ordered are delivered to the delivery address specified by the Customer when placing their order, whether placed via the Maison Sveltesse website or in person in Brussels, Rotterdam and The Hague.
Maison Sveltesse undertakes to ship orders within five (5) business days of order confirmation. This timeframe may vary depending on product availability and logistical conditions.
For Customers residing in Brussels, Rotterdam and The Hague, Maison Sveltesse offers in-person delivery by appointment. This option allows for the secure handover of products directly to the buyer, providing a personalised experience and an opportunity to check the products before accepting them.
In addition, Maison Sveltesse offers the possibility of delivering products to the pickup point nearest to the delivery address indicated by the Customer. This convenient solution allows the Customer to collect their purchases at an alternative location, close to their home or workplace.
It is important to note that Maison Sveltesse accepts no responsibility for delivery delays attributable to the carrier. In such cases, the Customer is invited to contact the carrier directly for any claim or parcel tracking required, in accordance with the legal provisions in force (Article 6:235 of the European Civil Code, Article L216-1 of the Consumer Code).
7. Customs Fees
Maison Sveltesse informs its Customers that customs fees may be payable for international deliveries outside the European Union. These fees are determined by the customs authorities of the destination country and may include import taxes, customs duties and handling fees.
The applicable customs fees are entirely the responsibility of the Customer. It is the Customer's responsibility to find out about the customs regulations in force in their country and to pay any taxes or customs duties required to receive their order.
Maison Sveltesse accepts no responsibility for additional fees related to customs formalities. By accepting these general terms and conditions of sale, the Customer acknowledges and accepts that Maison Sveltesse cannot be held responsible for these additional fees, in accordance with Article 6:236 of the European Civil Code and Article L221-15 of the Consumer Code.
7. Right of Withdrawal
In accordance with the legislation in force, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs. The products must be returned in their original condition and packaging (Article 6:230o of the European Civil Code, Articles L221-18 to L221-28 of the Consumer Code).
Returns for any reason other than a manufacturing defect are the buyer's responsibility. In the event of a manufacturing defect, Maison Sveltesse will cover the return costs.
8.1 Cases Where the Right of Withdrawal Is Excluded
The right of withdrawal cannot be exercised for the following contracts:
- The supply of goods made to the consumer's specifications or clearly personalised.
- The supply of goods that are liable to deteriorate or expire rapidly.
- The supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection.
- The supply of goods that, after being delivered and by their nature, are inseparably mixed with other items.
- The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
9. Warranty
Maison Sveltesse grants all Customers the following legal warranties for all products sold:
In accordance with the provisions of Article 6:230m of the European Civil Code and Articles L217-4 to L217-12 of the Consumer Code, all products sold by Maison Sveltesse benefit from a legal warranty of conformity. This warranty allows the Customer to request the repair or replacement of the product, or possibly a refund if the product is defective or does not conform to its description.
In accordance with Article 6:230p of the European Civil Code, Maison Sveltesse also warrants the products against hidden defects that could render them unfit for use or significantly reduce their value. In the event that a hidden defect is discovered, the Customer may choose between cancelling the sale or a reduction in the sale price.
To invoke one of the aforementioned warranties, the Customer must notify Maison Sveltesse in writing as soon as possible after discovering the defect or hidden flaw. The Customer must also provide proof of purchase and describe the defect found precisely.
Limitations: The legal warranties do not cover defects resulting from misuse, negligence, normal wear and tear or modification of the product by the Customer.
10. Liability
Maison Sveltesse accepts no responsibility in the event of non-performance of the concluded contract, in particular in the following situations:
In the event of a stock shortage or unavailability of an ordered product, Maison Sveltesse undertakes to inform the Customer as soon as possible and to offer, if possible, a substitute product or to proceed with a full refund of the order.
Maison Sveltesse cannot be held responsible in the event of force majeure. Events considered as force majeure include, without limitation, natural disasters (such as floods, fires), total or partial strikes affecting postal services, means of transport or communications, as well as any other unforeseeable circumstance beyond the control of Maison Sveltesse.
By accepting these general terms and conditions of sale, the Customer acknowledges and accepts that Maison Sveltesse cannot be held responsible for these situations, in accordance with Article 6:75 of the European Civil Code and Article L221-15 of the Consumer Code.
11. Protection of Personal Data
Maison Sveltesse attaches great importance to the protection of its Customers' personal data. The information collected from the Customer when placing an order is necessary for managing the commercial transaction. It may be communicated in whole or in part to Maison Sveltesse's service providers involved in fulfilling the order, such as carriers or secure payment providers.
In accordance with Article 6:230f of the European Civil Code and Articles L223-1 to L223-2 of the Consumer Code, the Customer has the right to access, modify, rectify and delete the data concerning them. To exercise these rights, the Customer may contact Maison Sveltesse in writing at the address indicated on the company's website.
The personal data collected by Maison Sveltesse is stored securely and is used only within the legal framework provided for by the European regulation on the protection of personal data (GDPR).
By accepting these general terms and conditions of sale, the Customer acknowledges and accepts that their personal data is collected and processed in accordance with the legal provisions in force and the principles set out in this personal data protection clause.
11. Intellectual Property
All elements of the Maison Sveltesse website, including but not limited to text, graphic, software, visual and audio content, are and remain the exclusive intellectual property of Maison Sveltesse.
In accordance with Article L122-4 of the Intellectual Property Code, no element of the Maison Sveltesse site may be reproduced, exploited, redistributed or used in any way whatsoever, even partially, without the express written consent of Maison Sveltesse. This includes in particular reproduction on another website, use in a commercial or non-commercial context, or any other form of exploitation.
Customers are authorised to use the Maison Sveltesse website solely for their personal browsing and to make purchases in accordance with these general terms and conditions of sale. Any use beyond these purposes requires prior authorisation from Maison Sveltesse.
Maison Sveltesse reserves the right to take legal action against any person or entity that infringes its intellectual property rights, in accordance with the legal provisions in force.
By accepting these general terms and conditions of sale, the Customer acknowledges and accepts that all intellectual property rights associated with the Maison Sveltesse website are protected and belong exclusively to Maison Sveltesse, unless expressly stated otherwise.
13. Applicable Law and Competent Jurisdiction
These general terms and conditions of sale (GTC) are subject to Belgian and European law, given that Maison Sveltesse is located and operates in Europe.
In the event of a dispute arising from these GTC, Maison Sveltesse undertakes to seek an amicable solution with the Customer before any legal action. This approach aims to find a satisfactory agreement for both parties, in accordance with Article 6:236k of the European Civil Code and Article L221-15 of the Consumer Code.
Failing an amicable solution, any dispute relating to these GTC will fall under the exclusive jurisdiction of the courts of the judicial district of Brussels. This clause complies with European legislation, which provides that the courts of the place where the consumer is domiciled have jurisdiction over disputes relating to the sale of goods or the provision of services.
By accepting these general terms and conditions of sale, the Customer acknowledges that Belgian and European law governs the contractual relationship with Maison Sveltesse, and also acknowledges the jurisdiction of the courts of Brussels in the event of a dispute.
